Article 1: Creating Comic service
Creating Comic is a platform designed to allow you to create the comic strip of your dreams without any knowledge of drawing or scriptwriting thanks to cutting-edge tools based on artificial intelligence (the "Services").
This Acceptable Use Policy defines the conditions under which Creating Comic makes its Services available to Customers, provided that you comply with the Use Policy, applicable laws and regulations, and any other documentation, recommendations or policies that we make available to you.
The Creating Comic website is accessible free of charge anywhere to any user with Internet access (the "User"). You are responsible for all costs related to accessing the Service, including hardware, software, and Internet connectivity.
Article 2: Services offered by the Site
Access to the Site is strictly reserved for non-professional Customers acting in a private capacity, which the Customer declares and acknowledges when using the services of the site, undertaking, in addition, to carry out in good faith, all purchasing transactions concluded with Creating Comic.
Use of the site is free for Customers (excluding any connection costs charged by the operator) and without obligation to purchase. To use Creating Comic's services, the Customer must accept these Acceptable Use Policy and register on the Site. Strictly confidential and personal usernames and passwords are then assigned to them. The Customer undertakes to keep these codes confidential and is prohibited from disclosing them to any person whatsoever. The Customer is solely responsible for the use of these codes and access to the site, unless there is evidence of fraudulent use that cannot be attributed to them. Any fraudulent use of these codes of which the Customer becomes aware must be immediately notified in writing to Creating Comic.

In the event of non-compliance with this Accptance Use Policy by the Client, Creating Comic reserves the right to temporarily or permanently interrupt its access, by suspending or terminating this Acceptance Use Policy without notice or compensation.
Article 3: User behavior
The User declares and acknowledges that all information, data, texts, images or any other content that he uses for the Services on the Site are under his entire and sole responsibility.
The User undertakes not to use content contrary to the laws and regulations in force.
In particular, the User is prohibited from:
- to disseminate information contrary to public order or morality;
- to divert the purpose of the Site to engage in propaganda or proselytism, prospecting or soliciting;
- to distribute Contributions that infringe the personality rights of third parties or that are defamatory, abusive, obscene, pornographic, offensive, violent or inciting discrimination, political, racist, xenophobic, sexist or homophobic violence;
- to publish information that contravenes legislation on the protection of personal data that allows the identification of natural persons without their consent, in particular their surname, postal and/or electronic address, telephone number, photograph, sound or audiovisual recording, or to collect and store personal data relating to other Users;
- to fraudulently access the Site;
- to transmit any message containing computer viruses or any other code, file or program designed in particular to interrupt, destroy or limit the functionality in particular of any software, computer, or telecommunications tool;
- to provide information referring to other sites (whether by the creation of hypertext links or by the simple provision of information) whose content could contravene any law or regulation in force, and in particular could infringe the rights of persons and property and/or intellectual property rights.
The User also undertakes not to infringe the intellectual property rights of third parties.
The User undertakes to comply with the laws and regulations in force and to only use content for which he/she has the rights, or for which the rights holder has given his/her express consent for their distribution, or which is free of any rights.
The User undertakes, where applicable, to compensate Creating Comic for any damage directly or indirectly linked to non-compliance with this guarantee.
Any User who contravenes the provisions of this Acceptance Use Policy is liable to applicable civil and criminal prosecution.
Article 4: Data collection
The site ensures that your personal information is collected and processed in a manner that respects your privacy in accordance with Article 5 of European Union Regulation 2016/679, which stipulates that you have the right to access, rectify, delete, and oppose your personal data, as well as the right to data portability and to lodge a complaint with a supervisory authority, per our Personal Data Management Policy.
Article 5: Intellectual property
The brands, logos, signs and all contents of the site (texts, images, sound, etc.) are protected by the French Intellectual Property Code and more particularly by copyright. Texts and images generated in the creation of a comic strip are excluded from this copyright. However, you must own or have permission to use any third-party content you may provide in your comics.
For any reproduction, publication or copy of the various contents of the site you must request our prior authorization. You agree to use the contents of the site in a strictly private context, any use for commercial and advertising purposes is strictly prohibited.
Any total or partial representation of this site by any process whatsoever, without our express prior authorization would constitute an infringement punishable by Article L335-2 and following of the French Intellectual Property Code. In accordance with Article 122-5 of the French Intellectual Property Code, any person who reproduces, copies or publishes protected content must cite the author and its source.

Article 6: Responsibility
The sources of information disseminated on the Creating Comic site are deemed reliable but the site does not guarantee that it is free from defects, errors or omissions.
The information provided is presented for informational and general purposes only and has no contractual value. Despite regular updates, the Creating Comic site cannot be held responsible for changes to administrative and legal provisions occurring after publication. Similarly, Creating Comic cannot be held responsible for the use and interpretation of the information contained in the site.
Creating Comic shall not be liable for any infringement of copyright, trademark or other intellectual property rights, or any illegal or unauthorized use.
The Creating Comic site cannot be held responsible for any viruses that may infect your computer or any computer equipment following use, access, or downloading of content from the website.
Creating Comic cannot under any circumstances be held responsible for the technical availability of websites or mobile applications operated by third parties (including its potential partners) which the User accesses via hypertext links on the Site.
Creating Comic assumes no responsibility for the content, advertising, products and/or services available on such third-party sites and mobile applications, which are reminded that they are governed by their own terms of use.
Creating Comic is also not responsible for transactions between the User and any advertiser, professional or merchant (including its possible partners) to whom the User concerned may be directed via the Site and may not under any circumstances be a party to any possible disputes with these third parties, particularly concerning the delivery of products and/or services, guarantees, declarations and any other obligations to which these third parties are bound.
Finally, the site cannot be held liable in the event of force majeure or the unforeseeable and insurmountable act of a third party.
Article 7: Traitement des plaintes
Creating Comic has set up a system allowing any User to bring to its attention to the following email address contact@creating-comic.com any dispute, complaint or use of the Site for litigious purposes of which they are aware.
Any User may also request Creating Comic to take appropriate measures, such as the removal of content protected by intellectual property rights, by bringing it to their attention by email and in which they provide the following information:
- for individuals: their surname, first name, address and telephone number;
- for legal entities: their name, company name, address, telephone number and the identity of their legal representative;
- the description of the disputed content and the reasons why the content is disputed (including in particular the mention of the legal provisions which the content contravenes as well as factual justifications);
- the date on which the disputed content was noted;
- the URL address of the disputed content.
Creating Comic reserves the right to suspend or terminate the accounts of Users who repeatedly violate this Policy. Users may request an explanation or appeal a moderation decision by submitting an appeal via email to contact@creating-comic.com for further review.
Article 8: Limitations
As a digital professional, we are doing everything we can to keep the Creating Comic service operational and offer you a unique comic creation experience. The Service may experience temporary interruptions due to technical issues, updates, or third-party service failures. We will work to restore access promptly.
Article 9: Cookies
We inform you that during your visits on our website, cookies may be automatically installed on your Internet browser software. Cookies are small files temporarily stored on your computer's hard drive by your browser and are necessary for the use of the Creating Comic site.

Article 10: Creation and publication
The content generated using Creating Comic's services, including the text and images in your comics, is entirely yours. Creating Comic releases all rights to this content and will not use, sell or claim any ownership rights over it.
The site allows creators to publish their comics in the gallery. In your publications, you agree to respect the rules of good conduct of the Internet and the rules of law in force. The site may exercise moderation on publications and reserves the right to refuse to put them online, without having to justify it.
You remain the owner of all your intellectual property rights. However, by publishing in the gallery, you grant us a non-exclusive, royalty-free license to display your comic on the site and promote it on our social media channels. Our publishing company is committed to displaying your username near each use of your publication.
The content you post may be removed or modified by the site at any time and for any reason, without notice.
- Failure to comply with the law or the rules of proper use of the site set out in this Acceptance Use Policy;
- Technical problem or technical migration.
Article 11: Applicable law and competent jurisdiction
French law applies to these Conditions. In the event of failure to resolve a dispute between the parties amicably, the French courts will have sole jurisdiction to hear the dispute.
